There was a motion to accept the minutes of the May 5th meeting.  The motion was seconded and accepted with a vote of 5-0-0.

There was a motion to accept the minutes of the May 19th meeting with one correction.  The motion was seconded and accepted with a vote of 5-0-0.

Mr. Nick Alfieri’s Agent’s Report has been appended to the minutes.

        Minor Buffer Zone Activity:  11 Thomas Drive
        Ms. Suzanne Walmsley, the applicant, appeared before the Commission for the     installation of a 24 ft. above-ground swimming pool in the rear yard.  The pool will be         constructed outside of the 50 ft. buffer zone.

        Mr. Alfieri recommended 2 additional special conditions which are listed in the Agent’s         Report.

        There was a motion to issue a Negative Determination with 3 standard conditions, 2      special pool conditions and 2 additional conditions as recommended by the Conservation  Agent.  The motion was seconded and accepted with a vote of 5-0-0.              

        Minor Buffer Zone Activity:  33 & 34 Quince Landing
        Mr. Chris Campbell of Campbell Construction appeared before the Commission for the      construction of a deck at each of the above-mentioned condos at Spruce Pond Village.  
        
        Mr. Campbell informed the Commission that he will be taking down 2 decks and digging    8 new footings with sono tubes and constructing new 10’x20’ decks.  The proposed work   will take place approximately 30 ft. from Spruce Pond.  The deck will be composed of            composite material.

        There was a motion to issue a Negative Determination for 33 Quince Landing with
        3 standard conditions.  The motion was seconded and accepted with a vote of 5-0-0.

        There was a motion to issue a Negative Determination for 34 Quince Landing with 3       standard conditions.  The motion was seconded and accepted with a vote of 5-0-0.

        Minor Buffer Zone Activity:  584 Maple Street
        Mr. & Mrs. Ron Libbey, the applicants, appeared before the Commission for the   construction of a 10’x14’ shed.  Mr. Alfieri stated that the wetlands are located 30 ft.        from the location of the proposed shed.

        There was a motion to issue a Negative Determination for 584 Maple Street subject to the        standard 3 conditions, notify the Agent before work commences, notify the Agent         after   work is completed, do the work according to the plan and 1 additional condition that no         toxic chemicals be stored in the shed and up to 5 gallons of gasoline may be stored in the      shed.  The motion was seconded and accepted with a vote of 5-0-0.
        
        Minor Buffer Zone Activity:  19 Echo Bridge Road
        Mr. Thomas O’Rourke, the applicant, appeared before the Commission to plant 4 trees             in previously disturbed area and construct a 10’x12’ shed in the backyard.  The shed will       be constructed on blocks.  

        All of the proposed work is located on the edge of the 100 ft. wetland line.  The       arborvitae trees would be located outside of Conservation jurisdiction.

        There was a motion to issue a Negative Determination for 19 Echo Bridge Road subject    to 5 conditions; notify Agent before the work starts, notify Agent when the work is     completed, do the work according to the plan, no toxic chemicals may be stored in the   shed, the arborvitae will be planted outside of Conservation jurisdiction.  The motion was      seconded and accepted with a vote of 4-0-1; 4 Yes, 0 No, 1 Abstention.


Public Hearing – Notice of Intent – 140 Maple Street – Frongillo – CE159-1017
Mr. Ray Willis, Commission member, recused himself from this public hearing.

Mr. Richard Frongillo, the applicant, and Mr. Dan Bremser of Hancock Associates, both appeared before the Commission for the construction of an addition to a single-family house.

Mr. Bremser provided the Commission with a detailed overview of the plans for the project.  
The proposed addition will be located 75 ft. away from the wetlands.  

The Commission Chairman stated that the lawn is pretty level and goes up to the wetlands at the rear of the property.  

Mr. Alfieri informed the applicant of 2 comments regarding this project and recommended the Commission discuss any special conditions with the applicant, close the public hearing and issue an Orders of Conditions at the next meeting.

A special condition discussed was a perpetual condition that no phosphorous containing fertilizers be used on the site.

There was a motion to close the public hearing for 140 Maple Street.  The motion was seconded and accepted with a vote of 4-0-1; 4 Yes. 0 No, 1 Abstention.

There was a motion to issue State and Local Orders of Conditions for 140 Maple Street subject to 32 special conditions.  The motion was seconded and accepted with a vote of 4-0-1; 4 Yes,
0 No, 1 Abstention.


Continued - Public Hearing – Notice of Intent – Lot 32 Garnet Drive – Staniscia – CE159-1014
Mr. Russ Waldron, Wetland Scientist, and Mr. Mark Staniscia, the applicant, both appeared before the Commission for the construction of a single-family house.

Mr. Waldron submitted revised plans and provided the Commission with a brief overview of these plans.  The planting plan has been greatly changed to depict the specified species of plantings requested by a Commission member at the last meeting.

Mr. Alfieri informed the applicant of 2 comments regarding this project and recommended the Commission discuss any special conditions with the applicant, close the public hearing and issue an Orders of Conditions at the next meeting.

Some special conditions discussed with the applicant were:

  • plaques placed on the fence
  • perpetual condition regarding post and rail fence at the edge of disturbance
  • 85% survival of plantings
  • no phosphorous containing fertilizers be used
There was a motion to close the public hearing for Lot 32 Garnet Drive.  The motion was seconded and accepted with a vote of 5-0-0.


Continued - Public Hearing – Notice of Intent – 16 Evergreen Drive – Rocco - CE159-1016
Mr. Jeff Alderson of Colonial Engineering, appeared before the Commission for the construction of an addition to a single-family house.


Mr. Alderson submitted revised plans for the Commission’s review and gave a brief overview of these plans.  There are 7 different revisions depicted on these plans.

Mr. Alfieri informed the applicant of an item to be addressed regarding the spacing of the plantings on these plans.

Some special conditions discussed with the applicant were:
        
  • final planting plan to be approved by the Agent
  • no phosphorous containing fertilizers to be used
  • no toxic chemicals be stored in the shed
  • no more than 5 gallons of gasoline be stored in the shed
There was a motion to close the public hearing for 16 Evergreen Drive.  The motion was seconded and accepted with a vote of 4-0-1; 4 Yes, 0 No, 1 Abstention.

Mr. Ray Willis, Commission member, recused himself from this public hearing.

Mr. William Yadisernia, Town Engineer, appeared before the Commission for improvements to existing stormwater detention pond.

Mr. Yadisernia gave the Commission an update of the progress made on the site since the last public hearing.  Mr. Yadisernia stated that all of the grading being proposed for the site is all within the envelope of the existing detention basin.  

A row of siltation controls; i.e., waddles, are proposed between the wetland and the outfall.

There was a motion to close the public hearing for Lockewood Drive.  The motion was seconded and accepted with a vote of 4-0-1; 4 Yes, 0 No, 1 Abstention.


GENERAL BUSINESS
        
        Certificate of Compliance:  21 Haverstock Road
        Mr. Alfieri informed the Commission that he has completed an inspection of the site and         the shed has been built and found it to be in compliance with the Orders of Conditions.

        There was a motion to issue a Certificate of Compliance for 21 Haverstock Road.  The    motion was seconded and accepted with a vote of 5-0-0.

        Discussion:  Roundtable Philosphy
        The Commission Chairman informed the members that this discussion will not take place   at tonight’s meeting.  However, Mark Cerel, Town Attorney, has recommended that the     Commission conduct a workshop with him to protect the Town’s interests.  This   workshop will be held in August or September.
